Baycol case: New life for whistleblower
The U.S. 8th Circuit Court of Appeals resuscitated a whistleblower’s lawsuit that claims Bayer Healthcare made fraudulent claims to induce the Department of Defense to buy its cholesterol-reducing drug, Baycol. Earlier, the suit was dismissed by a federal judge who concluded that the suit’s claims regarding sales of Baycol to Medicare and Medicaid were lodged after a six-year statute of limitations had expired.
